Brothers charged in Calgary teen's murder make brief first court appearances

The lawyer for two brothers charged with the murder of a Calgary teen is awaiting disclosure so he can determine if he will seek bail for the pair.

Defence counsel Alain Hepner made separate appearances in adult and youth court Monday on behalf of the two, who can’t be identified to protect the younger brother’s identity.

The siblings are charged with second-degree murder in the death last Tuesday of 18-year-old Danillo Glenn.

Glenn was pepper sprayed and then fatally stabbed at a basketball court on Copperstone Road S.E.

Police said Glenn was there with two friends when two individuals approached him and, following a brief altercation, he was killed.

Hepner told Justice Jim Ogle he is waiting for a Crown prosecutor to be assigned so he can receive disclosure and review the adult accused’s file.

The older brother, 18, appeared in Calgary Court of Justice via closed-circuit TV from the Calgary Remand Centre.

He did not address court other than to confirm his identity when asked by Ogle.

“I am retained by the family on this matter as well as a co-accused, a youth,” Hepner told the adult hearing.

Crown prosecutor Achilles Grobler said chief Crown Peter Mackenzie indicated a prosecutor would be assigned to the file on Monday.

Hepner said he spoke to the adult accused briefly on Sunday.

“Judicial interim release has to be considered,” he said, of the prospect of applying for bail for the accused.

The younger brother, 16, appeared via CCTV from the Calgary Young Offenders Centre before Justice Todd Larochelle.

He also did not address court other than to confirm his identity and that he could hear proceedings.

Hepner asked that both accused’s cases be adjourned to Sept. 22, so he can get disclosure and review his next steps.
